General use
The use of the music is free for all under the following conditions:

You receive a simple, non-exclusive right to use the music in a film project or audio project (e.g. radio play/radio spot).
In the video or audio project, the respective author and the website Filmmusic.io must be named.
The use for political purposes without written permission of the author is not permitted.
Offering the music file on other websites or file-sharing sites (for distribution, sale or download) is strictly prohibited.
Extended conditions and rights for registered users
Upon completion of the registration and the associated acceptance of the terms of use, a user account will be created which entitles the user to the extended license acquisition of music pieces from the Filmmusic.io music archive, among other things with the freedom that the naming of the author no longer applies.

After registration, the user can search the music archive for suitable pieces of music. The user selects music titles from the offer and places them in the license basket by clicking the button with the "shopping basket" symbol. The contents of the licence basket can be viewed at any time and deleted by clicking the "Remove from licence basket" button. If the user wants to acquire the licenses for a project free of charge within the scope of his membership, he fills out the project form with details of the licensee and a table of contents, saves this and completes the project.

After the creation of a project, the user receives the contractually assured rights of use for the specified licensees and the project and has the option to download these as proof in the form of a license document as a PDF file. This is a simple, non-exclusive right of use.

Use for political purposes must be approved in advance by the author in writing.

Warranty of the composer
Filmmusic.io assures that the sole and exclusive copyrights or rights of use exist. Furthermore, Filmmusic.io confirms that neither Filmmusic.io nor co-authors are members of GEMA or any other collecting society (e.g. ASCAP, PRS, SUISA, AKM etc.). Filmmusic.io expressly guarantees users GEMA freedom and freedom from the rights of other collecting societies.

There are no further fees, such as GEMA fees.

Rights of use / prohibitions
The right to use a piece of music is granted exclusively to the person designated as the "Licensee" and is not transferable to third parties. The right of use resulting from the acquisition of the license is always bound to the project named in this document.

The naming of the author is optional within the scope of the project and not obligatory.

A project refers to the production of a specific media product (e.g. image film, commercial, audio project, event) and its publication and performance in all media. As soon as the content of a media product is changed elsewhere, it is considered a new project. In this case, the music must be re-licensed. The acquired license is only valid for one project and one user. A new license is required for each additional project in which the same song is used.

The user is not permitted to license, sell and/or otherwise transfer the rights of use acquired under these GTC to other third parties. The placement and distribution of music files via file-sharing networks is also not permitted.

The user is not permitted to edit or redesign the pieces of music. This includes in particular new recordings, adding vocal or instrumental tracks, creating remixes and any other modification that changes the basic structure of the piece of music. Of course, the use of simple effects such as reverb, chorus, delay, "fade in" or "fade out" as well as the cutting, shortening and adjusting of the length of the pieces of music in order to adapt them to the project are permitted. It is also permitted to technically convert, store and compress the piece of music into the required format according to the respective technical requirements of a project. In the case of permissible changes and modifications, the copyright and ancillary copyrights to the pieces of music shall remain with the respective rights holders and may therefore not be distributed and/or sold under one's own name.

The use of the music titles may not take place in a context which is not compatible with the law and the constitution of the Federal Republic of Germany, the European Union, public order or morality. In particular, the use of music in projects connected with racism, glorification of violence, pornography or unconstitutional use is prohibited.

Complaint/conciliation of disputes
From 15 February 2016, the EU Commission will provide a platform for out-of-court dispute resolution. This gives consumers the opportunity to settle disputes in connection with their online order without the need for a court of law. The dispute resolution platform can be accessed via the external link ec.europa.eu/consumers/odr/ .

Change of conditions
Filmmusic.io may change over time and therefore reserves the right to make changes to the website, license terms and conditions at any time.

Final provisions
a) This document reproduces the agreements for the subject matter of the contract between the parties in full. Additional agreements and supplements require a separate written agreement.

e) The place of performance and jurisdiction for all matters arising in connection with these Terms of Use shall be Hanover. This does not affect mandatory legal jurisdictions.
